A. Vacancies in positions above the lowest rank that are not filled by appointments, transfers, reinstatements or reduction shall be filled by promotion.

B. Any candidate listed on a current promotional eligibility list who receives disciplinary action for any violation in accordance with Section 2.48.370 may be removed from the eligibility list by the City Manager. Candidates may also be removed from the list by the City Manager for any valid and documented reason that pertains to their inability to function within the rank to which they may be promoted. If an eligible candidate declines promotion, his or her name will be removed from the eligibility list.
